Dating Naked contestant sues series for showing her dating while naked

Aug 22, 2014 12:35 PM

A woman who appeared on the VH1 reality series Dating Naked — which involves people dating, naked—has filed a $10 million lawsuit against the network, after the show aired a scene in which she was naked in a way unbefitting of the dignity she was promised by producers of a show called Dating Naked . The plaintiff, Jessie Nizewitz, is a 28-year-old model whom viewers may know from the July 31 episode, nearly in a biblical sense: It featured a scene where she and her date wrestle naked on a beach, rendered tacky and salacious by a brief, uncensored shot of her crotch.

“I immediately started getting text messages. Everyone saw it. One of the messages read, ‘So your money shot is on cable TV,’” Nizewitz tells the New York Post of her terrible friends, some of whom clearly need to visit Urban Dictionary. She says she was further harassed on social media and YouTube, leading to “mental anguish, humiliation and embarrassment.” As argued in the suit, “Defendants knew or reasonably should have known that broadcasting an individual’s vagina and anus on national cable television would cause substantial and severe emotional distress”—particularly as Nizewitz and producers had agreed to broadcast only her blurred vagina and anus on national cable television, which would only cause a substantial and severe increase to her celebrity profile.

Shockingly, Nizewitz’s embarrassment even extended to her family. “My grandma saw it. I saw her this week and she didn’t have much to say to me. She’s probably mad. My parents are just annoyed,” Nizewitz said of these relatives who proudly tuned in to watch their little girl tussle naked with a complete stranger on a reality show, only to find something tawdry.

She also says it cost her a “budding relationship” with a guy she describes as “employed, Jewish, in his 30s and that’s pretty much ideal,” but who never called her back after the show aired. No doubt her would-be husband is out there now, searching for the kind of nice girl who will only go on national TV and grind her naked genitals against a man she’s just met behind the veil of digital pixilation, as per Jewish tradition.

In addition to the $10 million she’s seeking, Nizewitz believes she is owed a “huge apology” for the incredible humiliation she’s suffered from everyone who’s seen her crotch, including all of those who are only hearing about it right now.

Dating Naked Contestant Sues over Crotch Shot

From birthday suit to lawsuit.

Dating Naked cast member Jessie Nizewitz is suing VH1's parent company Viacom for breach of contract after the network aired uncensored au naturel footage of Nizewitz to shocked viewers of the titillating reality show.

The complaint, which was filed in Manhattan, also takes two production companies to task for broadcasting a clip in July during which a shot of Nizewitz's crotch was not blurred out.

The model says producers promised non-G-rated glimpses of her body would be appropriately concealed.

That's not exactly how it all went down on Dating Naked 's third episode, which showed Nizewitz, 28, and her potential paramour getting, well, down and dirty in the sand as they wrestled, setting the stage for the peek-a-boo in question.

The suit, obtained by PEOPLE, claims Nizewitz suffered "severe emotional distress, mental anguish, humiliation, and embarrassment" after the slip-up.

"I felt lied to, manipulated and used. I was horrified," the Long Island-based Nizewitz told the New York Post . adding, "I immediately started getting text messages. Everyone saw it."

She also says that the offending boob-tube exposé ruined a burgeoning romance.

"He never called me again after the show aired," she told the paper. "I would have hoped we could have had a long-term relationship."

Nizewitz is seeking $10 million in damages. A rep for the network declined to comment.

The Naked Truth: "Dating Naked" Contestant Sues for $10 Million

Jessie Nizewitz, a 28-year-old New York model and contestant on the VH1 show Dating Naked (trailer ) has filed a $10 million lawsuit against VH1's operator Viacom claiming that the show flashed an un-blurred image of her crotch during a scene where she and a male suitor were playfully wrestling on a beach. According to Entertainment Weekly. Nizewitz was assured that her genitals would be blurred and since the footage was revealed, she claims that she has been "humiliated on social media."

In her lawsuit, Nizewitz claims uncensored images of her were passed around Twitter, Facebook, Instagram and Tumblr after airing on VH1 and she is seeking recourse under a claim of intentional infliction of emotional distress. The Complaint states:

Plaintiff. was shocked, horrified and outraged to observe this intrusion into her privacy for all to see. Immediately Plaintiff became subject to ridicule by those watching. Plaintiff has suffered and continues to suffer extreme emotional distress, mental anguish, humiliation and embarrassment. Defendants knew or reasonably should have known that broadcasting an individual's vagina and anus on national cable television would cause substantial and severe emotional distress.

To recover under the tort of intentional infliction of emotional distress. Nizewitz must establish that Viacom engaged in "extreme or outrageous conduct" and that its conduct actually caused Nizewitz "severe" emotional distress. Nizewitz must prove that the conduct was either intentional or known by Viacom that it would likely cause great emotional distress. In Nizewitz's case, she's alleging that Viacom and the show's producers kept her nude shot un-blurred either intentionally or recklessly. Towards that end, she is claiming that they knew (or should have known) that it might cause her emotional distress. While Nizewitz might not have to establish some physical medical condition associated with the emotional distress, as normally required, she will need to provide some substantial evidence of her emotional distress in order to convince a judge or jury that Viacom and the show's producers owe her $10 million. This standard is quantified by the intensity, duration and any physical manifestations of the distress. However, other factors including lack of productivity and acquaintances' testimony about a change in behavior can also be persuasive.

When you're on a reality show called "Dating Naked," baring it all is part of the game. But one former contestant says her genitalia wasn't blurred in one scene when the show aired on VH1, and now she's suing for $10 million.

Jessie Nizewitz, a 28-year-old model, claims in a lawsuit filed against VH1 operator Viacom and two production companies that her crotch was briefly exposed in a scene where she wrestled with a male contestant on the beach. The lawsuit, filed in New York on Wednesday, states that uncensored images were sent around social media following the airing, and that Nizewitz was "shocked, horrified and outraged to observe this intrusion into her privacy for all to see."

"This is not what I anticipated," said Nizewitz in a statement to NBC.

Her suit also states that the show "promised that all frontal and genital nudity would be blurred out when broadcast."

"She has a problem that she's on a show called 'Dating Naked,'" said NBC News legal analyst Lisa Bloom on TODAY Friday. "Nevertheless, she has a reasonable argument that she did not expect to be broadcast fully naked even though she was taping the show actually nude."

VH1 and Viacom declined to comment on the case.

"Dating Naked" airs on VH1 Thursdays at 9 p. m.

Dating Naked Contestant Sues For Showing Her Naked??

by Suzy on August 23rd, 2014

When Vh1 debuted their new dating show, Dating Naked . I am sure they had high hopes of the show becoming a trending topic across social media. The show — which is exactly what is sounds like, contestants who have never met, date, while naked — has become a trending topic, but not for breaking ratings records.

Instead, everyone seems to be talking about the fact that a contestant has now sued Vh1′s parent company Viacom as well as two production companies because the show showed her too naked. For real!

Model Jessie Nizewitz has sued because her crotch was apparently flashed across the screen leading to screen shots to be shared by complete strangers across Twitter, Instagram and Facebook, supposedly humiliating Nizewitz . (FYI — Dating Naked typically shows bare buttocks, but breasts and genitals are heavily blurred.)

Through her attorney Jessie released a statement to Entertainment Weekly . “I have no problem going to a beach in a bikini or people seeing me on TV in a bikini. Although I went on this show knowing that I would be nude while taping it I was told that my private parts would be blurred for TV. If you watch an episode, you will see that the blur actually makes it less revealing than a bikini would. Obviously, I did not expect the world to see my private parts, this is not what I anticipated or what any other contestants on the show anticipated.”

The lawsuit reads. “Plaintiff… was shocked, horrified and outraged to observe this intrusion into her privacy for all to see. Immediately Plaintiff became subject to ridicule by those watching. … Plaintiff has suffered and continues to suffer extreme emotional distress, mental anguish, humiliation and embarrassment. … Defendants knew or reasonably should have known that broadcasting an individual’s vagina and anus on national cable television would cause substantial and severe emotional distress.”

And to make matters worse, a guy that Jessie had been dating stopped calling after the show aired. Which if course was because her genitals were flashed on national television.

Can we call shenanigans on this? Is this not the most ridiculous lawsuit. You went on Dating Naked and they showed you naked. Get over it!
